Terms of Service

AIMaker Studio is a service provided by BeMel Productions LLC. Users enter into this agreement with BeMel Productions LLC when accessing or using AIMaker Studio. By accessing or using AIMaker Studio, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service. References to "AIMaker Studio," "we," "our," or "us" in these Terms refer to BeMel Productions LLC and its products and services.

AIMaker Studio is owned, operated, and maintained by: BeMel Productions LLC State of Georgia, United States Business Type: Limited Liability Company (LLC) BeMel Productions LLC is the legal entity responsible for AIMaker Studio and all services provided through this platform.

AIMaker Studio grants you a limited, non-exclusive, non-transferable license to use the platform for personal and commercial creative purposes, subject to these Terms. You agree not to: • Use the service for any unlawful purpose • Generate content that violates our AI Usage Guidelines • Attempt to reverse engineer or copy the platform • Resell or redistribute access to AIMaker Studio without authorization • Use automated tools to scrape or extract data from the platform

AIMaker Studio provides AI-assisted tools that may help you develop business concepts, business names, brands, logos, slogans, products, services, plans, images, videos, copy, marketing materials, social content, and other creative or commercial materials. BeMel Productions LLC does NOT guarantee that any generated or suggested output: • Is unique, accurate, complete, or suitable for your intended purpose • Is commercially viable or available for trademark, copyright, patent, domain-name, business-name, or other registration • Does not resemble existing third-party material • Does not infringe intellectual-property or other rights of any third party • Qualifies for copyright or other legal protection • Complies with laws or regulations applicable to your business or location AIMaker Studio may help you develop an idea, business, brand, product, or content — but it does not legally clear that output for commercial use. You must independently evaluate all outputs before publishing, registering, selling, manufacturing, advertising, distributing, implementing, or otherwise using them commercially.

You are solely responsible for conducting appropriate independent checks before any commercial use of AI-generated or platform-assisted outputs. Depending on your intended use, this may include: • Trademark searches and clearance • Copyright review • Business-name availability • Domain-name availability • Licenses, permits, and registrations • Tax and regulatory requirements • Product and advertising rules • Professional licensing requirements • Factual accuracy and safety verification • Suitability for your intended purpose • Contractual obligations • Third-party rights You are responsible for what you choose to publish, sell, advertise, register, distribute, manufacture, implement, or otherwise use. AIMaker Studio is a creation and development tool and is not a substitute for professional review.

AIMaker Studio and its AI-generated content do not constitute legal advice, tax advice, accounting advice, financial or investment advice, medical advice, regulatory advice, professional licensing advice, or any other form of professional advice. Business Builder recommendations, business plans, projected ideas, strategy suggestions, pricing suggestions, market observations, and similar outputs are informational and creative assistance only. They are not professional opinions and should not be relied upon as such. You should obtain qualified professional advice — including from attorneys, accountants, financial advisors, and other licensed professionals — when appropriate for your situation.

The AIMaker Studio platform, including its design, code, branding, and non-user-generated content, is the property of BeMel Productions LLC and is protected by applicable intellectual property laws. Content you generate using AIMaker Studio using your own prompts and inputs is generally yours to use, subject to the limitations described in our AI Usage Guidelines and applicable third-party AI provider terms. However, BeMel Productions LLC does not guarantee that AI-assisted output is automatically owned by you, automatically copyrightable, or available for registration. The copyright or other protectability of AI-assisted output may depend on applicable law and the amount and nature of human creative contribution. You must not intentionally use AIMaker Studio to infringe copyrights, trademarks, patents, rights of publicity, privacy rights, trade secrets, or other intellectual-property or proprietary rights of any third party. You must have appropriate rights or permission for any content you upload to the platform.

You agree not to use AIMaker Studio for any of the following: • Impersonation intended to deceive others • Fraud or deceptive practices • Creating or promoting counterfeit goods • Unauthorized use of third-party brands, logos, or trademarks • Intentional infringement of intellectual-property rights • Unlawful exploitation of another person's likeness or identity • Harmful, harassing, or illegal activity • Attempts to circumvent security measures or platform restrictions • Any activity that violates applicable local, state, national, or international law Violations may result in immediate account suspension or termination and may be reported to appropriate authorities.

AIMaker Studio operates on a credit-based system. Credits are consumed when you use AI generation features. Payment processing is handled by our secure payment providers. All purchases are subject to our Refund Policy. AI and provider processing costs incurred through credit use are generally non-refundable. BeMel Productions LLC reserves the right to modify credit pricing and plans with reasonable notice.

AIMaker Studio is provided "as is" and "as available" without warranties of any kind, either express or implied. BeMel Productions LLC does not warrant that the service will be uninterrupted, error-free, or completely secure. BeMel Productions LLC expressly disclaims all warranties regarding the accuracy, completeness, suitability, commercial viability, or fitness for any particular purpose of AI-generated or platform-assisted outputs.

To the maximum extent permitted by applicable law, BeMel Productions LLC and AIMaker Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of AIMaker Studio, including but not limited to: • Business losses or lost profits • Lost opportunities or revenue • Intellectual-property disputes or infringement claims • Rejected trademark, copyright, patent, business-name, or domain-name registrations • Regulatory consequences or fines • Inaccuracies in AI-generated content • Third-party claims arising from your use of generated content • Losses resulting from your reliance on, publication of, sale of, registration of, or implementation of AI-generated or platform-assisted outputs This limitation applies regardless of the theory of liability and even if BeMel Productions LLC has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless BeMel Productions LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: • Content you upload, create, or distribute using AIMaker Studio • Your commercial activities using AI-generated or platform-assisted outputs • Your use of generated content in any publication, registration, sale, advertisement, or distribution • Your violation of these Terms of Service • Your violation of any applicable law or regulation • Your infringement or alleged infringement of any third-party intellectual-property or other rights

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Except where prohibited by applicable law, you agree that any legal action arising from these Terms shall be brought in the state or federal courts located in Georgia, United States.

BeMel Productions LLC reserves the right to modify these Terms of Service at any time. We will notify users of significant changes. Continued use of AIMaker Studio after changes constitutes acceptance of the updated terms.

This section describes how copyright owners or their authorized agents may notify BeMel Productions LLC, operator of AIMaker Studio, of allegedly infringing material, and how users may submit a counter-notification. BeMel Productions LLC respects the intellectual-property rights of others and expects users of AIMaker Studio to do the same. We respond to properly submitted notices of alleged copyright infringement in accordance with applicable law. IMPORTANT: Submitting a copyright notice does not automatically result in removal of content. We review each notice individually. Knowingly submitting a false or misleading notice may expose you to legal liability.

To report material on AIMaker Studio that you believe infringes your copyright, please send a written notice containing all of the following to legal@aimakerstudio.net: 1. Identification of the copyrighted work — Describe the copyrighted work you claim has been infringed, or if multiple works are covered by a single notice, a representative list of those works. 2. Identification of the allegedly infringing material — Identify the specific material on AIMaker Studio that you claim is infringing and provide sufficient information to allow us to locate it (for example, a URL or description of where the material appears). 3. Your contact information — Provide your full name, mailing address, telephone number, and email address. 4. Good-faith belief statement — Include the following statement: "I have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law." 5. Accuracy and authority statement — Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed." 6. If you believe that material you posted on AIMaker Studio was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to legal@aimakerstudio.net containing all of the following: 1. Identification of the removed material — Identify the specific material that was removed and the location where it appeared before removal. 2. Your contact information — Provide your full name, mailing address, telephone number, and email address. 3. Good-faith belief statement — Include the following statement: "I have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled." 4. Consent to jurisdiction — Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, the judicial district in which BeMel Productions LLC is located, and I will accept service of process from the person who provided the original notification or an agent of such person." 5. Accuracy statement — Include the following statement: "I swear, under penalty of perjury, that I have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification." 6. BeMel Productions LLC reserves the right to terminate accounts of users who are found to be repeat infringers of third-party intellectual-property rights. The existence of this copyright notice policy does not constitute a representation by BeMel Productions LLC that it qualifies for any particular safe harbor under applicable copyright law. BeMel Productions LLC has not represented that it is registered as a designated DMCA agent with the U.S. Copyright Office.
